California gives most injury victims two years from the date of the injury to file a lawsuit, under California Code of Civil Procedure Section 335.1. Miss that deadline and the claim is generally gone no matter how strong it was. Shorter deadlines apply when a government entity is involved, which covers collisions with city vehicles, Metro buses, and injuries caused by dangerous public property. Those claims can require a formal administrative claim within six months, so the safest assumption is that your real deadline is sooner than you think.
How Much Time You Have to File in California
Where Your Los Angeles Case Would Actually Be Filed
This is worth understanding, because it changed recently and a lot of published guidance is out of date.
Until 2022, most Los Angeles County personal injury cases were funneled into a centralized Personal Injury Hub at the Spring Street Courthouse downtown. That hub began phasing out on October 10, 2022, and new personal injury cases are now filed in the judicial district where the incident happened, then assigned to a single judge who handles the case from filing through trial. Cases arising in the Central District have, since January 8, 2024, been assigned to Independent Calendar departments at the Stanley Mosk Courthouse.
In practical terms, a collision in Pomona, Pasadena, Compton, Inglewood, Van Nuys, Torrance, or Chatsworth is now filed and heard in that district rather than downtown. Filing in the wrong location costs weeks. It also means the honest answer to "which courthouse will my case be in" is that it depends on where you were hurt, and any firm quoting you the Spring Street hub is working from information that is several years stale.
About the Attorney Handling Your Case
David Kashani is an Angeleno. He earned his Bachelor of Arts at the University of California, Los Angeles, worked in Los Angeles personal injury firms for several years before law school, and built his practice here.
After law school he began his legal career as a securities and compliance lawyer. He left that work for injury law, partly because he found he would rather represent people than institutions, and partly because he lost someone close to him in an accident. He opened this firm to represent individuals and families harmed by someone else's negligence, and he takes every client's case personally, as though a member of his own family had been injured. His practice has recovered millions of dollars for injured clients.
He is admitted to practice in five states, California, New York, Massachusetts, Washington, and Arizona, and holds his law degree from Whittier Law School. Locally he belongs to the Consumer Attorneys Association of Los Angeles and the Los Angeles County Bar Association, and nationally to the American Association for Justice.
