How long do I have to file a car accident claim in California?

Can I still recover if I was partly at fault for the crash?
Yes. California follows pure comparative negligence, which reduces your recovery in proportion to your share of fault but never bars it. If you are found 30% responsible, you recover 70% of your damages, and there is no percentage cutoff that ends your claim. Adjusters frequently overstate a claimant's share of fault, and that assessment is negotiable.

What if I was not wearing a seatbelt?
You can still bring a claim. Under California Vehicle Code Section 27315, failing to wear a seatbelt does not by itself establish negligence and does not bar recovery.
